Man turns himself in after incident

Michael M. Hicks, 20, of El Dorado, turned himself in to the Union County Sheriff’s Office early Wednesday morning, after deputies were dispatched to Massey Drive in reference to Hicks pointing a 40 cal. semi automatic pistol at another man, according to a UCSO report.

According to the report, Tony Smith, the complainant, said that he had walked to a neighbor’s house on Massey Drive and was outside talking when two white cars arrived at the scene. He told the deputy that one of the drivers was Michael Hicks.

Smith told the deputy that when Hicks pulled up, he pointed the pistol at him. Smith told Hicks that he didn’t want to fight but Hicks threw a punch anyway, according to the report. Smith told the deputy that he tried to defend himself and that he punched Hicks a few times. Another subject, according to the report, told Smith that he was not leaving. Smith was chased by the other subject and struck in the head with a stick, according to the report.

Smith called 9-1-1 and went to the emergency room for injuries he received in the altercation.

After speaking with Smith, the deputy patrolled the area looking for the two cars that had been described by Smith. A vehicle matching the description was located at a residence across from the Wildwood subdivision, according to the report. The deputy noted that he pulled into the driveway of the residence and made contact with the homeowner, who was the uncle of Hicks. The uncle explained that the white vehicle was Hicks’, but that Hicks had left prior to the deputy’s arrival, according to the report.

The deputy made contact with Hicks’ mother and she tried to make contact with him by phone regarding the situation at Massey Drive.

Hicks turned himself in to the UCSO and was arrested on charges of battery in the third-degree and aggravated assault. This is not the first situation regarding Hicks and Smith, though, according to reports.

According to a police log entry dated June 16, a deputy responded to Massey Drive in reference to a subject pointing a gun at juveniles while they were outside playing. Dispatch advised that the subject was Michael Hicks and he was driving a white vehicle, according to the report.

Upon arrival, the deputy noted that he spoke with the victim, Smith, who said he was outside weed-eating his front yard when Hicks stopped in front of his residence and yelled his name while pointing a black colored handgun at him. Smith said the vehicle had three other subjects inside, according to the report.

The deputy noted that while speaking with Smith, he still seemed shaken up by what had transpired. Smith told the deputy that he feared for his life.

Smith’s sister then came forward and said she was looking out the window of a residence and noticed the white colored vehicle stop in front of the home, according to the report. She saw a man lean out of the window and point something at her brother. She couldn’t confirm that the driver was pointing a handgun.

At this time, a BOLO (be on the lookout) was issued by the El Dorado Police Department for the white vehicle and Michael Hicks. The officer noted at the end of the report that attempts to locate Hicks and the vehicle were unsuccessful at that time.

Hicks was issued a $10,000 unsecured bond requiring signatures of four registered voters at his first appearance in court on Wednesday. He is accused of aggravated assault and third degree battery. District Judge George VanHook reminded Hicks that this was the least restrictive bond and required no money to release him from jail, during a session of court on Wednesday.
