A 21-year-old male was sentenced to six years in prison during Union County Circuit Court today for violations to his probation including failing to report, neglecting to pay fees and allegedly having sex with a 13-year-old girl.
The hearing was easily the longest of the morning and included testimony by the now 14-year-old victim, a now 16-year-old male friend and his mother.
The alleged victim advised that the incident occurred in August 2011 at the Econo Lodge hotel where she told Defendant Jullian Cain that she was 13 and he responded that he was 17. As the evening progressed, the two smoked marijuana with a pair of friends and later had intercourse on the balcony, she said.
However, her male friend, then 15, said he was never sure of the victim’s age and has been present when she lied about her age to the defendant’s brother, telling him when she was 12 that she was 16. The male friend’s mother added that she herself never was sure of the victim’s age.
Though the substantive second-degree sexual assault case was dismissed following testimony, Cain was still found to have violated the terms of his probation and sentenced to six years in the Arkansas Department of Correction.
